Adult Consultative Examination Reports

When an adult Social Security Disability Insurance claimant fails to provide, or provides inadequate, medical information to make a "disability" determination, the Social Security Administration (SSA) will request that a consultative examination (CE) be performed. The claimant's treating physician or an independent medical source may perform the CE. When the CE has been completed, a report must be provided to the SSA that meets the minimum requirements specified by the SSA. More...

Act of God and the Concept of "Arising Out of the Employment"

An act of God includes natural occurrences over which man generally has no control such as tornadoes, hurricanes, earthquakes, and lightening. Though an employee is injured due to an act of God, he may still recover workers' compensation benefits if he can show that the nature of his employment placed him at a greater risk for injury due to such an act of God. He performs his work while a thunderstorm rages by standing in a bucket raised high into the air from the back of his repair truck. This situation would appear to elevate the employee's chances of being struck by lightening over the average individual. As such, it is likely that the employee would be compensated for an injury by lightening.More...

To obtain his benefits, a homeless individual may pick up his payments at a local Social Security office, have the payments mailed to a third party, have the funds automatically deposited into a personal bank account, or have the payments sent to a representative payee who will act in the individual's best interests.More...
